DATA PROTECTION CLAUSE<\/strong><\/h1>\n

1. PROVISION AND OWNERSHIP OF DATA<\/strong><\/p>\n

In connection with the provision of the contracted services, in my capacity as a user and for the purposes stated in the scope of the service, I provide 4-BEYOND S.A.S. with personal data such as names, identification document numbers, telephone numbers, addresses, dates of birth, video and photographic recordings, and, in general, any type of personal information that may be required by 4-BEYOND S.A.S. for the efficient and proper provision of the contracted services, as applicable in each case (hereinafter, the \u201cDATA\u201d).<\/p>\n

For these purposes, and in accordance with Statutory Law No. 1581 of 2012 and Decree 1377 of 2013, 4-BEYOND S.A.S., as the provider of the service for BUSINESS AND MANAGEMENT CONSULTING ACTIVITIES, acts as the DATA PROCESSOR and undertakes to comply with the obligations applicable to such role.<\/p>\n

4-BEYOND S.A.S. expressly acknowledges that the data it processes as Data Processor is the exclusive property of the service user. Accordingly, it may not use or process such data for purposes other than those established in the applicable contract, agreement, or service proposal.<\/p>\n

4-BEYOND S.A.S. may only access the data provided by the user as necessary to fulfill the purpose of the services it provides and will process such data in accordance with the instructions set forth below. Under no circumstances shall such access be deemed a disclosure or transfer of personal data.<\/p>\n

2. DATA PROCESSING<\/strong><\/p>\n

4-BEYOND S.A.S. undertakes to process the data solely for the purpose of providing the contracted service.<\/p>\n

4-BEYOND S.A.S. agrees to use the data made available by the user exclusively for the purposes necessary to provide the service.<\/p>\n

Likewise, 4-BEYOND S.A.S. undertakes to safeguard the personal data and prevent access to such data by any third party outside the contractual relationship between 4-BEYOND S.A.S. and the user.<\/p>\n

The foregoing obligations shall apply to any person who may be involved in any stage of the processing on behalf of 4-BEYOND S.A.S. and shall remain in effect even after the processing activities carried out in connection with the services provided to the user have ended.<\/p>\n

4-BEYOND S.A.S. undertakes to communicate these obligations to its employees assigned to provide services to the user and to ensure their compliance.<\/p>\n

4-BEYOND S.A.S. is hereby freely, priorly, expressly, voluntarily, unequivocally, and duly informedly authorized to use the information provided in connection with the provision of the contracted services. Notwithstanding the foregoing, the user may request, at any time, the correction of information held in 4-BEYOND S.A.S.\u2019s databases or the deletion of such information from its information systems by contacting:<\/p>\n

3. SECURITY MEASURES<\/strong><\/p>\n

A)<\/strong> 4-BEYOND S.A.S. represents that it complies with applicable data protection laws and regulations, particularly with the security measures required to safeguard the integrity and security of personal data.<\/p>\n

B)<\/strong> The personnel of 4-BEYOND S.A.S. will be informed of their duties regarding the custody and confidentiality of the data and documentation under their responsibility, as well as their functions, obligations, and the security requirements applicable to their activities. These duties and requirements will be clearly defined and documented.<\/p>\n

C)<\/strong> Where personal data is processed through 4-BEYOND S.A.S. systems, the company will have mechanisms in place to uniquely and individually identify and authenticate system users.<\/p>\n

D)<\/strong> The system will have access profiles established according to the assignment of duties and responsibilities related to the processing of personal data, ensuring that each user can access only the resources necessary to perform their functions.<\/p>\n

E)<\/strong> 4-BEYOND S.A.S. will maintain backup and recovery mechanisms capable of restoring the data to the state in which it existed in the event of loss or destruction.<\/p>\n

F)<\/strong> If it is necessary to carry out any part of the data processing outside 4-BEYOND S.A.S. facilities, including through portable devices or USB storage devices, such processing must be authorized in accordance with the procedures established by the duly designated data controllers.<\/p>\n

Any use of the data that does not comply with the provisions of this document shall be the sole responsibility of 4-BEYOND S.A.S. In such cases, 4-BEYOND S.A.S. shall be liable to third parties and to the user for any damages that may result from such use and shall also be considered responsible for the processing of the data for these purposes.<\/p>\n
